Terms of service

These terms apply when you use our website and when you buy plants, products and services from The Plant Collector as a consumer. They sit alongside our Shipping Policy, Refund and Cancellation Policy, Price Promise and Privacy Policy. Nothing in these terms affects your statutory rights as a consumer.

1. About us

The Plant Collector Limited is a private company registered in Ireland under company number 720366. Our registered office and nursery are at Stacumny, Celbridge, Co. Kildare, W23 HN6Y. Our VAT number is IE4249951JH.

You can contact us by email at sales@theplantcollector.com, by phone on +353 1 437 0916, or by visiting the nursery, which is open Monday to Saturday from 9am to 5pm, and Sundays and bank holidays from 10am to 5pm.

These terms are in English, and we can only conclude contracts in English. Trade and designer account customers buy under our separate trade terms. Garden design and landscape build work is contracted separately by Outlook Gardens Limited under its own written contract.

2. Using our website

You may use our website for personal, lawful purposes. Please do not copy or reuse our photographs, plant descriptions or other content without our written permission. Growing advice on our website is general guidance. For advice on your own site and soil, speak to one of our horticulturists.

We work to keep the website accurate, secure and available, but we cannot promise that it will always be uninterrupted. Links to other websites are provided for convenience, and we are not responsible for their content.

3. Our plants and products

Every plant we sell is a living thing and an individual. Our photographs show typical examples unless a listing says it shows the actual plant. If you would like to see the exact plant before you buy, ask us and we will send photographs or arrange a visit.

We measure height from the top of the rootball to the tip of the crown. For standard trees we also give clear stem height and trunk girth. Plants change through the seasons, so deciduous plants will be without leaves in winter and some perennials die back below ground. That is natural and is not a fault.

Every plant is labelled with its full botanical name and carries a plant passport where the law requires one. Our team will gladly advise on whether a plant suits your site, but the final choice of plant and position is yours unless we have designed or planted the scheme for you.

4. Prices

Our prices are in euro and include VAT. Delivery charges are shown separately before you pay. The price that applies is the one shown when you place your order.

If we make an obvious pricing error, we will tell you before your order is dispatched or collected. You can then go ahead at the correct price or cancel for a full refund. We will never charge you more than the price you agreed without your consent.

When we announce a reduced price, we show the lowest price we charged for that item in the 30 days before the reduction, as the law requires.

5. How your order becomes a contract

When you place an order online, we send you an email acknowledging it. The contract between us is formed when we send you an email confirming the order. For orders placed in the nursery or by phone, the contract is formed when we accept your order and payment or deposit.

If, after confirming, we find that a plant is no longer available or not of the standard you are entitled to expect, we will tell you straight away. We may offer you an equivalent plant, but we will never substitute one without your approval. If you do not want the alternative, we will refund you in full for that item.

6. Payment

We accept the major debit and credit cards, Apple Pay and Google Pay, and Klarna. If you choose Klarna, your payment plan is a separate agreement between you and Klarna on Klarna’s terms.

Online orders are paid in full at checkout. A 50% deposit reserves stock for you for 14 days. For plants we order in for you, we take a deposit when you order. In both cases the balance is due before delivery or collection, and we confirm the deposit and due date to you in writing.

Ownership of the goods passes to you when we have received full payment. The goods are your responsibility from the time they are delivered to you or collected by you.

7. Delivery and collection

Our Shipping Policy sets out where we deliver, what it costs, how long it takes and how collection works. If we have not agreed a delivery date with you, we will deliver within 30 days of the contract being formed.

8. Cancelling, returns and refunds

Your rights if something is faulty, your 14-day right to cancel online, phone and email orders, our goodwill returns policy and our 12-month establishment guarantee are explained in our Refund and Cancellation Policy. You can cancel an online order at any time within the cancellation period using the Cancel contract here link at the foot of every page.

9. Planting, consultations and the Project Centre

Planting is quoted in writing before you commit, and includes delivery. When we plant your trees and plants and maintain them under one of our maintenance agreements, our 12-month establishment guarantee applies on the conditions set out in our Refund and Cancellation Policy.

A consultation or Project Centre session costs €250. Where either leads to a plant order of more than €2,500, the €250 is credited in full against that order, with no time limit. The credit applies to plant orders, not to design fees.

10. Membership offers

Members of our mailing list receive 10% off full-price retail plants and garden products, early access to events and invitations to members-only sales. The member discount cannot be combined with trade or designer pricing, sale prices, members-only sale prices, the Price Promise or the Project Centre credit. The member discount does not apply in our café. We may change the membership offer by giving at least 30 days’ notice by email and on our website.

11. Gift cards

Gift cards are valid for at least five years from the date of purchase and can be used in the nursery and online, including over several purchases. We do not charge any fee for buying, holding or using a gift card. Please keep your gift card safe, as we cannot replace one that is lost or stolen unless it is registered to you.

12. Our responsibility to you

If we break these terms or are negligent, we are responsible for loss or damage you suffer that is a foreseeable result. We are not responsible for loss or damage that was not foreseeable. Because we sell to consumers for private use, we are not responsible for any loss of profit, business or business opportunity.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law, including your rights under the Consumer Rights Act 2022.

13. Events outside our control

Weather, ground conditions, frost, official plant health restrictions and disruption in our growers’ supply chains can delay lifting, delivery or planting. If something outside our reasonable control affects your order, we will tell you as soon as we can and do what we reasonably can to limit the delay. If the delay is likely to be substantial, you may cancel and we will refund what you have paid for the goods or services not provided.

14. Accessibility

We want everyone to be able to shop with us. Our Accessibility Statement explains how our website meets accessibility requirements and how to tell us about any barrier you find. If our website does not work for you, you can order by phone, by email or in person at the same prices.

15. Complaints and disputes

If you have a complaint, email sales@theplantcollector.com or call +353 1 437 0916. We will acknowledge it within two working days and give you a full response within five working days, or tell you when you can expect one.

If we cannot resolve it, you can contact the Competition and Consumer Protection Commission at ccpc.ie, or bring a claim of up to €2,000 through the Small Claims procedure of the District Court.

These terms are governed by Irish law, and you can bring proceedings in the Irish courts. If you live elsewhere in the European Union, you also keep the protection of the mandatory consumer law of the country where you live.

16. Changes to these terms

We may update these terms from time to time. The terms that apply to your order are those published when you place it. We keep earlier versions and will send you a copy on request.

17. General

If a court decides that any part of these terms is unenforceable, the rest remains in force. If we do not enforce a right straight away, we can still enforce it later. Only you and we have rights under the contract between us.
